Landowners don’t like it when the state tries to take over their land. That shouldn’t be surprising. That’s why BYOP, the Texas version of BYOP, doesn’t give developers access to the state’s ability to take over private land. That means that developers will have to find landowners and communities that voluntarily agree to their project.
